Construction Litigation

We have extensive experience representing owners, contractors, and subcontractors in disputes involving private construction projects. When disputes such as breaches of contract, construction defect claims, or 93A claims of deceptive and unfair conduct arise as part of a construction project or purchase, TDD understands the legal tools to use to help you bring the matter to a successful resolution. We have provided legal counsel to clients working on the most high-profile and complex development projects in the region, but we also have deep experience in much smaller residential construction matters, including on behalf of homeowners. No matter the size of your project, we understand the importance of developing cost-effective strategies to promptly and favorably resolve these matters, often without resort to formal litigation. But if litigation cannot be avoided, we bring the same results-oriented focus on achieving a winning outcome for the client.

Meghan Huggan’s practice focuses primarily on the areas of business litigation, land use disputes, and construction and real estate litigation.  

Meghan received her J.D. from Suffolk University Law School in 2019. While in law school, Meghan was a Senior Editor on the Suffolk Journal of High Technology. Meghan also competed on the Suffolk Law School National Trial Team and won the 2018 3rd Year Day/4th Year Evening Mock Trial Competition.

Before joining Tymann, Davis & Duffy, Meghan completed a yearlong clerkship in the New Jersey state courts for Superior Court Judge Benjamin Podolnick, before working as a litigation associate at a mid-sized Boston law firm. Meghan gained valuable legal experience before and during law school as well, working as a paralegal and law clerk at Massachusetts and Rhode Island litigation firms. 

Meghan received Bachelor of Science degrees in Legal Studies and Psychology from Roger Williams University.

Admitted to Practice: Massachusetts; U.S. District Court for the District of Massachusetts.

 

Successful outcomes for our construction clients include:

 
  • Represented largest concrete and asphalt supplier on Boston's "Big Dig" in multi-year, multi-agency investigation and related qui tam and other litigation, achieving favorable global settlement for company.

  • Achieved low-dollar, no-liability settlement for materials client in series of construction defect cases in which plaintiffs alleged over $20 million in damages.

  • Successfully resolved government inquiry for highway contractor on high-profile commuter injury on I-495 reconstruction project.  

  • For concrete contractor, won Superior Court dismissal on contested motions in construction defect litigation.

  • On behalf of homeowners whose property was damaged by faulty inground pool project, brought an arbitration action under the Massachusetts Home Improvement Contractor program that led to a favorable six-figure settlement for clients.

  • Successfully moved for dismissal of claims for negligence and breach of contract brought by homeowner against home inspection firm.

  • Obtained favorable settlement on behalf of homeowners in lawsuit against contractor for negligent construction and improper billing.

  • Represented contractor on casino project in multiyear litigation involving allegations of construction defects and improper billing, achieving favorable settlement that resolved all claims.
